Privacy Policy
Effective & last updated:
Your privacy matters to us. This policy explains what information we collect, why we collect it, who we share it with, and the choices you have — including how to stop text messages and emails at any time.
1. Who We Are & Scope
This Privacy Policy explains how Inked City Tattoos ("Inked City," "we," "us," or "our"), located at 1462 Liberty St, Trenton, NJ 08629, collects, uses, shares, and protects personal information when you visit this website, submit our contact or booking form, use our website assistant, receive text messages or emails from us, or visit our studio.
This policy is governed by the laws of the United States and the State of New Jersey. Your use of our website is also subject to our Terms & Conditions.
2. Information We Collect
Information you give us online:
- Name, email address, and phone number.
- Service requested, preferred artist, and the description of your tattoo or piercing idea.
- Your communication preferences, including whether you agreed to receive service-related and/or marketing messages.
Information we collect automatically:
- When you submit our form, we record the date and time, your IP address, your browser type (user agent), and the exact consent language you agreed to, so we can document your consent as required by law.
- Standard server logs kept by our hosting provider (such as IP address, pages requested, and browser type) for security and performance.
Information collected at the studio:
- Government-issued photo ID to verify your age, and the client consent, release, and health-disclosure forms required under New Jersey body art regulations (N.J.A.C. 8:27).
- Payment information processed at the point of sale.
- Photographs of your finished tattoo or piercing, only as described in Section 7.
Please do not send medical or health information through our website form or website assistant. We collect health information only in person, on our studio consent forms, and only to perform your service safely.
3. How We Use Your Information
- To respond to your inquiry and schedule, confirm, remind you of, or reschedule appointments.
- To send service-related messages you agreed to receive (for example, deposit, aftercare, or schedule changes).
- To send promotional messages only if you separately opted in to marketing.
- To verify your age and eligibility and to keep records required by New Jersey law.
- To keep proof of your communication consent and honor opt-out requests.
- To operate, secure, and improve our website and services.
- To comply with legal obligations and protect our rights, our clients, and our staff.
4. Text Messages (SMS) & Mobile Information
We send text messages only to people who have given us consent. Service-related messages (appointment reminders, confirmations, and basic communication about your booking) and marketing messages are separate choices — you may agree to one, both, or neither. Consent to receive text messages is never a condition of purchasing any service.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties. Your phone number may be shared only with the service providers that deliver our messages on our behalf, under contract, and for no other purpose.
Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. Full program details are in the Text Messaging section of our Terms & Conditions.
5. How We Share Information
We do not sell your personal information, and we do not share it for targeted (cross-context behavioral) advertising. We share information only as follows:
- Service providers that help us run our business, under obligations to protect your information and use it only for our purposes — including our website host (Vercel), our booking and records database (Airtable), our website voice/chat assistant provider (ElevenLabs), embedded maps (Google Maps), and the text-messaging and email providers we use to contact you.
- Legal requirements — when required by law, subpoena, or a request from a health department or other government authority, or to protect the safety of any person.
- Business transfers — in connection with a sale or transfer of our business, subject to this policy.
- With your consent — for any other purpose you approve.
6. Website Assistant
Our website includes an optional AI voice and chat assistant powered by ElevenLabs. If you choose to use it, your voice and/or messages are transmitted to and processed by ElevenLabs to generate responses and may be recorded and stored by that provider. The assistant provides general information only and cannot book, change, or cancel appointments on its own. Please do not share sensitive personal or health information with the assistant.
7. Photos of Your Work
With your permission, our artists may photograph your finished tattoo or piercing and display the images in our portfolio, website, and social media. We avoid showing faces or identifying features unless you agree. You may decline before your session, or ask us at any time to remove an image of you from our website and the social accounts we control, and we will do so within a reasonable time.
8. Your Communication Choices
- Text messages: reply STOP to any message to stop all texts from us.
- Email: click the unsubscribe link in any marketing email.
- Any other reasonable way: you may also opt out by telling us in person, by phone, or by email at inkedcitytattoosnj@gmail.com.
9. Cookies & Tracking
We do not use advertising cookies or sell data collected through cookies. Our site uses only the technologies needed to function and stay secure. Embedded third-party features, such as Google Maps and our website assistant, may set their own cookies under their own privacy policies. We treat a Global Privacy Control (GPC) signal from your browser as a valid request to opt out of any sale or targeted advertising, although we do not engage in either.
10. Data Retention
- Website inquiries: kept as long as needed to respond and serve you, generally no longer than 3 years after our last contact.
- Consent and opt-out records: kept for at least 5 years after your last message from us, so we can prove consent and honor your choices.
- Studio client records and consent forms: kept for the period required by New Jersey body art regulations and other applicable law.
11. Data Security & Breach Notification
We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure. If a breach of security involving your personal information occurs, we will notify you and the appropriate authorities as required by the New Jersey Identity Theft Prevention Act (N.J.S.A. 56:8-161 et seq.) and other applicable law.
12. Your Privacy Rights
Regardless of where you live, you may ask us to:
- Confirm whether we hold your personal information and give you a copy of it.
- Correct inaccurate information.
- Delete your information, unless we must keep it by law (for example, studio health records).
- Stop using your information for marketing.
New Jersey residents: we honor the rights described in the New Jersey Data Privacy Act (N.J.S.A. 56:8-166.4 et seq.), including access, correction, deletion, data portability, and opting out of sale, targeted advertising, and profiling. We will respond within 45 days. If we deny your request, you may appeal by replying to our decision with the subject line "Privacy Appeal," and we will respond to your appeal within 45 days. If you are not satisfied, you may contact the New Jersey Division of Consumer Affairs.
To make a request, email inkedcitytattoosnj@gmail.com or call (609) 695-4294. We may need to verify your identity. You may use an authorized agent, and we will not discriminate against you for exercising your rights.
13. Children's Privacy
Our website and services are intended for adults 18 and older. We do not knowingly collect personal information from children under 13, consistent with the Children's Online Privacy Protection Act (COPPA), or from anyone under 18 through this website. If you believe a minor has sent us information, contact us and we will delete it.
14. Changes to This Policy
We may update this Privacy Policy from time to time. The "last updated" date above shows when it last changed. We will not use your information in a materially different way than described here without giving you notice and, where required by law, obtaining your consent.
